However, I have read, understood and agree to be severally and jointly bound by the terms and Conditions set out both on the front and back of this Agreement relating to the collection of sewerage and agree to pay all charged due under this Agreement.

TERMS AND CONDITONS FOR THE COLLECTION AND DISPOSAL OF SEWRAGE

  1. Sewerage collection services under this Agreement shall be supplied in accordance with these Standard Conditions. Any conditions expressed or implied which in any way add to, modify or are in contradiction to these Standard Conditions shall be excluded and not form part of this Agreement unless each of such conditions has been specifically agreed in writing by both parties.
  2. This Agreement remains in force for a minimum of [One] year(s) after the start date. Thereafter, the Agreement shall continue on a [ month by month/ year by year ] basis until terminated by either party by providing to the other party 30 business days notice in writing prior to the termination date. All notices and other communications pursuant to this Agreement shall be in writing and hand delivered or sent by e-mail or fax transmission to the addresses shown in this Agreement.
  3. The Client shall allow Haya Water employees, agents and /or subcontractors to access the premises at all reasonable times to empty, ascertain the condition of the septic tank and for any other purpose connected to the sewerage collection service.
  4. Access to the septic tank shall be free from obstructions, vegetation and any other reason that would impede vacuuming the septic tank and such impediment prolongs for more than 30 minutes then Haya at its sole discretion may charge 50% of the cost of the collection specified in item (2) of the Agreement without prejudice to Haya’s right to terminate the service shall such impediments continues or reoccurs.
  5. Client is required to ensure that all access to the septic tank is via a suitably constructed carriageway, drive or hard standing. The carriage wary should have a minimum width of 3 meters along its length.
  6. Collection times will be during normal working hours between [ 06.00 am ] and [ 10.00 pm ], The Client will be informed, prior to the visit, when the emptying will be carried out. Haya Water shall not be liable for any delays in carrying out the emptying of the tank. Haya shall be liable to pay any fines and/or penalties payable to the concerned authorities as a result of its failure to carry out its obligation prescribed under this Agreement.
  7. Haya Water will not be held liable for any damage arising from the weight of the tanker vehicle.
  8. Haya Water will not be held liable for any spillages or blockages.
  9. The cost of emptying is, as stated in Section 3 overleaf subject to change with 30 days notice prior to change. If an appointment has been pre-arranged and access to the tank or property is not possible due to the fault of the Client a charge may be made at the discretion of Haya Water. The cost per emptying may vary due to access restrictions to the property /tank.
  10. Payments in respect of the collection of sewerage under this Agreement shall be due from the Client within [30 ] days of receipt of an invoice from Haya Water. If an invoice remains unpaid for more than [ 35 ] days, interest shall accrue on the overdue amount on a daily basis from the due date up to the date of actual payment at a rate of seven (7) per cent till the date of actual payment with out prejudice to Haya’s right to terminate the services and pursue any remedy available under this Agreement and the Laws of Oman.. Any interest accruing under this Clause shall be compounded with the overdue amount and shall be immediately payable by the Client on demand by Haya Water.. Notification of termination including the Client moving out of the property must be sent in writing to Haya Water at the address shown in section 1 overleaf.
  11. Payment will be only by certified bank cheque payable to Oman Wastewater Services Company SAOC or by wire transfer to Oman Wastewater Services Company bank account with Oman Arab Bank bearing No [3104-704804-501]
  12. The Client hereby indemnifies Haya Water, its employees, agents and/or subcontractors against all actions, proceeding, claims, costs or expenses in respect of loss or damage to any real or personal property or injury to or death of any person caused by or arising directly or indirectly as a result of any action or omission or default or negligence of the Client or of any servant or agent of the Client or any other person under his control except to the extent that it an be evidenced that any such loss, damage or injury or death was caused by the negligence of Haya Water or any servant of it.
  13. Haya Water reserves the right to amend this Standard Conditions and charges for collection of sewerage subject to one month’s notice in writing to the Client.
  14. Haya Water reserves the right to alter, amend or withdraw the sewerage Collection service provided under this Agreement if the Client fails to meet any of its obligations under this Agreement, or for such other reasons as Haya Water may, at its absolute discretion, decide.
  15. In the event that Haya Water shall be rendered wholly or partly unable to carry out its obligations under this Agreement by reasons or cause beyond its control, including by way of illustration (but not limited to), fire, flood, explosion, action of the elements, acts of God, accidents, epidemics, strikes, lockouts, or other labor troubles, insurrection, riot, or other civil commotion, war, enemy action, Government orders or by any other cause which it could not reasonably be expected to foresee or avoid, then the performance of its obligations in so far as they are affected by such cause shall be excused during the continuance of any inability so caused. Such causes shall however as far as possible be remedied by the affected party with all reasonable dispatch.
